Timothy - 75. Chapter 75

Sitting in her office, I presented Tom’s case. Starting from the beginning, Ann Marie’s rape, up to the last encounter Thomas had with Bruce. As I told and showed her the various documents I had, I noticed she wasn’t interested. I expected more questions, and she only asked for the dates of Ann Marie’s rape and Thomas’s last encounter with Bruce.

I finished my presentation, “Miss Wiess, when will the DA take action on these issues?”

“The rape case happened over 20 years ago and is beyond the statute of limitations. In the case involving Mr. Thomas Boulder, I’m not sure the DA will want to pursue it. Two men, of who one seems unable to defend himself, would be difficult to prosecute. I will apprise the DA, but I don’t think he will want to proceed.”

“If I am reading you correctly, you feel forced sex on a homosexual isn’t worth prosecuting.”

“Well, let’s say it has a low priority.”

“I have an appointment with Judge Howard; I’ll ask him if he agrees with you.”

“Tim, don’t forget we have that interview with Richard Drawing.”

“Miss Wiess, I’m sorry that you feel like you do. I suggest that you rethink your position before you read about it in the newspaper and receive a call from Judge Howard.”

Leaving the office, “Tim, look who is here.”

“Rich, I was going to give you a call.”

“I was hanging around here looking for any potential news for the paper, and I saw you both entering the DA’s office. I decided to wait. So what’s happening?”

“Let’s get a cup of coffee, and I’ll bring you up to date.”

Sitting in the cafe where Donny and I often visited, I brought Rich up to date on Stephen and my meeting with Miss Wiess. “Do you have the feeling she isn’t going to pursue this case?”

“Yes, I have a distinct feeling she is anti-gay. I’m sure there are people gay people living here. With the way she feels, no gay person will have a fair hearing.”

I spent the rest of our coffee talking about Tom. “It is hard to believe that a man could be raped, and in Tom’s case, it was blackmail. Tim, I’ll do everything I can to help you, and maybe I’ll see if I can get an interview with Miss Wiess.”

“If you do, keep me in the loop.”

Finishing our second cup of coffee, Stephen and I headed to Judge Howard’s office. We didn’t have an appointment, but I was willing to take the chance of him being able to see me. Luck was with me. When we arrived, court was in session. They said the judge was addressing the jury and should be available within an hour.

We waited in a small room adjacent to the court. “Tim, how big is this city?”

“You talking square miles or population?”

“Population.”

“When I lived here, the population was a little over 250, 000. Now I would guess closer to 300,000. Why?”

“There must be an organization to support gay people. I wonder if Rich knows of any gay organizations.”

“Why are you asking?”

“I think Rich is going to print a story about the DA’s office refusing to prosecute Bruce. I’m wondering what will happen when the people read it.”

“When we get home, you can scan for gay organxations here.”

Fifteen minutes later, the clerk came to get us. “The judge has only 30 minutes.”

It would be a quick meeting. “Hello, your Honor. I was told you only had 30 minutes, so I’ll be brief. I have been to the DA’s office seeking justice for Thomas Boulder. Since he is a gay man, they feel it has low priority and may decide not to pursue the case. If you can look these papers over, I’d appreciate your comments.”

“Timothy, how is your sister. The last time we met, you wanted financial control.”

“She is doing fine. I enrolled her in a program at a hospital near my home. Under proper care, she is doing well. I’d expect her release in a few months.”

“Does this have anything with that newspaper article about girls being raped twenty-two years ago?”

“Yes, sir, it does.”

“I’ll read these papers. If I have any questions, I’ll give you a call.”

I gave him my business card, saying goodbye, we left.

 

Driving home, “What do you think is going to happen?”

“I don’t know. Rich will probably put something in the newspaper. Not sure what Judge Howard is going to do. I know what I’d like for him to do, but I can’t be sure.”

I wondered if the ass DA was just a there just because of what Tim was doing.   Seems just a little  odd the DA happened to be unavailable.  I  am thinking there are many  more victims or actual participants to the rapes and abuse tha that has been happening.  Let the population read and know what is going on in their community with not wanting ro prosecute rape of anyone one gay or  not.  I have the feeling that Donnie my voice his support to Tim with more information that can be discovered.  If so,  Good for Donnie and Tim. 

Too many elected officials have taken their jobs to their heads and forgotten why they are there.  To protect the public.

There are multiple explanations for why the DA would not speak with Timothy himself/herself:

  • (Pessimistic/Realistic) The DA isn’t interested in going after this case because of the gay element, mostly for reasons stated by previous commentators.  There is also the element of the years that have passed.
  • (Pessimistic) The DA is an old buddy of Brucie and given orders to bury this case.
  • (Realistic) The DA is the person in overall charge of all prosecutorial legal cases in the judicial area and may not, in all reality, have time to speak with Timothy, not realizing just how big a case this will turn out to be.  That’s why there are ADAs.  They take care of the details and deal with individual cases with supervision by the DA.
  • (Realistic) The ADA, Ms. Weiss, could be looking at how this case could/would help her career in the DAs office.  It may not be that she has a prejudice against gay people (although that’s still a possibility), but she is definitely looking at the case with a jaundiced eye.  It is very true that these kinds of cases are notoriously difficult to win, especially after this amount of time and considering Brucie’s standing within the community and his credentials.  This is why Timothy is going after Brucie for Tom’s rape, rather than AM’s.  However, Tom, as a teacher, no matter how many master’s, or other degrees, he may hold, will not hold the same level of respect as Brucie with his single doctorate.  I won’t even touch the topic of Tom being gay and making these allegations.

I'd definitely say this chapter is, as well as others, an overwhelming success based on the thought provoking discussion it has caused. LUV the conversation and thoughtful interpretations of the possibilities and potential outcomes. Makes the story even that much more interesting and intriguing. THANKS @CLJobe and others for keeping it fun!

The slope is getting slippery and hopefully the Judge can add some gravel to it with his gavel. 

There isn't any isolation from bigotry , small cities, large cities you will always find people willing to take up a cause to satisfy their need for acceptance and willl do that by supporting anything that the majority doesn't. We see it among those who are against vaccinations for Covid

I have never heard of a DA not at least discussing a. case and maybe prioritizing. I wonder if the case was ever presented to the DA

I'm not sure what to make of Helen, the Assistant DA and her attitude. You would have thought the DA would want to prosecute Bruce.

I think the Assistant DA made the decision.

For those reading from outside the U.S. and may not be aware, in the U.S.  the senior 'people' (DA's, judges in addition to politicians)  are elected. Rich needs to remind his newspaper readers who are members of disadvantaged groups to get off their butts and VOTE these WOS ( Waste of Skin) OUT of Office.

Thanks. The Assistant DA's are vital to handling the case loads in a large city, but prejudices are hard to ignore.

I have a question was a rape ever officially reported with AM?I'm not a lawyer(thank God) but if there is no official report there is no statute of limitations I would think but Tim would  know that so I'm probably mistaken

The rape was never reported thanks to Mom. That is why the statue of limitations is in effect

No the rape was never reported.

Tim is using that to sue Bruce for. money

Look at the cases of the victims of the Catholic Church.  Many are not coming forward until decades later for whatever reason—shame, fear, naivety, etc., yet they are being prosecuted.  

In today’s world, especially in the US, people are very aware of what constitutes sexual, or other kinds of, abuse.  40-50 years ago, maybe not so much.  And people were afraid to ‘rock the boat’ by making accusations against those who held any kind of authority, and Brucie did as a top athlete in his school.  There was a strong possibility of retaliations, especially if the ‘Star’ of the basketball team would lose his position and they lost the State Championship.  There is, and has been for a long time, WAY too much emphasis on the importance of sports and the ‘Superstars’ who act like it’s the only reason for living.

School administration have always looked upon sport stars in a different light. if the games created revenue, even more so.

You are correct. And I have a feeling Tim may experiencing some of this.

In a large community, many cases are handles by the Assistant DA,  however these cases are reviewed with the DA even if the Assistant is the one who prosecutors the case.
