  1. The teacher's conduct was probably "unethical" and would probably warrant professional discipline and termination of employment. However in order to prepare a case against the school board they will have to overcome extreme odds. The essential elements of an intentional infliction of emotional distress (tort) claim are as follows: 1) the defendant must act intentionally or recklessly; (2) the defendant's conduct must be extreme and outrageous; and (3) the conduct must be the cause (4) of severe emotional distress. With respect to the teachers conduct, the issue at trial will be whether an objectively reasonable person would find the teachers conduct "so outrageous in character, and so extreme in degree, as to go beyond all possible bounds of decency, and to be regarded as atrocious, and utterly intolerable in a civilized community." I believe the average person, when learning of facts, takes into consideration the peculiar sensibilities of the alleged victim when considering whether the teachers conduct is extreme and outrageous. This lawyer who filed suit should choose his battles more wisely.

Having said this, it is still certainly worth placing a copyright notice on your work. A copyright notice reminds others that copyright exists, and may therefore help to deter infringement. In the US, a notice was required to retain copyright on works published before January 1st 1978, but this was the exception not the norm, and is certainly no longer the case. Also, once the US signed up to the Berne convention, US law was amended, and the use of copyright notices became optional on work published from March 1st 1989. Posting on the Internet is publication.

  12. I agree with you Kitty, it does happen quite often, what women can do is find legal aid in their area where they don't have to pay for the lawyer if they're not financially able. My best advice for them is to call their local Legal Bar Association and they will direct them, they can also contact their states child enforcement agency and apply for service. In recent years the States have stepped in and started acting as the middle-man but in a lot of older divorces they never were involved and in some states the state only gets involved in the actual payments if the mother is getting State Aid or if the payments aren't getting there at all. And on another note, parental rights and duties are INDEPENDENT with respect to an existing parent/child relationship. This means that a parent has the right to maintain a meaningful relationship with his/her child. This right is neither dependent upon nor contingent upon the parent fulfilling duties, i.e., paying support. Some custodial parents will often times refuse to allow noncustodial parents the right to visit their children because support obligations have not been paid or are overdue. However, if support is not being paid, the custodial parent may not lawfully withhold visitation. Rather, the custodial parent must seek to enforce the duty of support in a court of law. The right to a meaningful relationship with one's child is NOT dependent on the duty of support. In this respect, rights and duties are independent. Visitation is presumed to be in the best interests of the child. However, that presumption can be rebutted.

  14. Today an Orange County family court judge took away a six-year-old girl from her mother and the only home she's known since birth. The judge decided to do so because the mother perjured herself and falsely accused the father of sexually fondling their child to prevent him from gaining custody or any visitation privilege. Perjury doesn't necessarily mean a mother is unfit to raise her child, and that is normally the main central point. The father has gained primary custody and the mother was ordered to pay child support. I think the judge's reasoning and this theory he followed holds the idea that taking the child away from the lying parent IS in the best interest of the child. Do you agree with the Judges decision?

  19. First of all I've never been a cat person, then one day I was walking in a parking lot to my car and this little skinny kitten came walking up to me. He was a little kitten barely 6 weeks old. I took him home and had plans on finding a home for him. The first night I had he home he became very ill. The next day I took him into see a vet, the kitten had some virus infection and the vet said he had a 50/50 chance of surviving. I had to give him medication 4 times a day for a full week. After that I became attached to the little bugger, well he's almost two years old now, weighs 18lbs and his name is Dewey.

    Today was actually a very rough day at work, Arbitration can be very stressful. But today I looked in the mirror and saw a weary person. I saw the same weary face I see everyday, looking at least 10 years older than I actually am, and I don't like it very much. I only look in mirrors when I have to shave.
